INDEMNIFICATION AND HOLD HARMLESS AGREEMENT
WAIVER OF ALL AND ANY LIABILITIES
Read carefully before signing
- I, __________________________________, the undersigned have read and understand and freely and voluntarily enter into this Release and Hold Harmless Agreement with Alexandra’s Cross Country Club (the club), its members and representatives understanding that this Release and Hold Harmless Agreement is a waiver of all and any liabilities.
- I fully understand the potential dangers that I could incur in mounting, riding, jumping, walking, boarding and feeding a horse, including but not limited to any interaction with other others horses and riders. Understanding those risks, I hereby release the club, it’s officers, directors, shareholders, employees, contractors and anyone else directly or indirectly connected with the club from any liability whatsoever in the event of injury or damage of any nature or death to me or anyone else caused by or incidental to my electing to mount and ride a horse owned by myself or anyone else.
- I understand and recognize and warrant that this Release and Hold Harmless Agreement is being voluntarily and intentionally signed and agreed to, and that in signing this Release and Hold Harmless Agreement I know and understand that this Release and Hold Harmless Agreement may further limit the liability of equine professionals to include any activity whatsoever involving a horse, including death, personal injury and/or damage to property.
- I recognize and agree that I know which equine professional(s) I will be working with, and acknowledge that I agreed that said equine professional(s) has/have made reasonable and prudent efforts to determine my ability to engage in the equine activity, and has/have sufficient knowledge of my equine and horseback riding skills as to relieve, release and hold harmless said equine professional(s) from any continuing duty to monitor my equine activities.
- I further voluntarily agree and warrant to Release and Hold Harmless this (these) equine professional(s) from any liability whatsoever, but not limited to any incident caused by or related to said equine professional(s) negligence, relating to injuries known, unknown, otherwise not herein disclosed; including but not limited to injuries, death or property damage from: mounting, riding, jumping, dismounting, walking, grooming, feeding, use of barn, paddock, trails, jumps or arenas in any capacity; falling off horse whether horse is backing, flipping, jumping, spooking, refusing, or because of failure to understand equine professional(s) directions relating to my riding or otherwise use and control, or lack thereof, my horse or the horse I have been assigned to.
- HELMET WARNING, I am aware that protective gear which meets or exceeds the quality standard of the SEI certified and ASTM standard F1163 equestrian helmet should be purchased and worn by me/and or my child while riding and being near horses and the wearing of such helmet may reduce the severity of some injuries and may prevent serious injury or death as a result of a fall or other occurrence. Alexandra’s Cross Country Club requires all riders minor or adult to wear helmets while mounted. If I or my minor child do not wear a helmet, it is because we so choose.

UNDER COLORADO LAW AN EQUINE PROFESSIONAL IS NOT LIABLE FOR ANY INJURY TO OR DEATH OF A PARTICIPANT IN EQUINE ATIVITIES RESULTING FROM THE INHERENT RISKS OF EQUINE ACTIVITIES, PURSUANT TO SECTION 13-21.120
